General Data Protection Regulation (Protection of Personal Data)

The Company Heberger CZ s.r.o., Reg. No.: 61508926, registred in the office at Teplárenská 608/11, Malešice, 108 00 Praha 10 (hereinafter "Company" or "Administrator"), protects personal data and other confidential information obtained and processed in the course of its activities. The Company collects and further processes personal data in accordance with Act No. 101/2000 Coll., on the Protection of Personal Data (hereinafter "the Act"), Regulation 2016/679 of the European Parliament and of the Council (EU) on the Protection of Individuals in connection with the processing of personal data and the free movement of such data and repealing Directive 95/46 / ES (hereinafter referred to as "the Regulation"), and a new law supplementing some GDPR provisions, replacing the Act after 25th of May 2018. (hereinafter referred to as "legislation").

The company processes only such personal data that is necessary to meet contractual or legal requirements within the company's activities.

  1. Category of processed personal data

The company processes the following personal data:

Address and identification data of the physical persons serving for the clear and unmistakable identification of the data subject (name and surname, title, eventually birth number, date of birth, address of permanent residence, Organization's ID, tax ident. number, personal identification number), personal data of physical persons representing legal entities to the extent necessary for the implementation of the contractual relationship and data enabling contact with the data subject (contact address, telephone number, fax number, e-mail address and other similar information),

Descriptive data (e.g., bank account),

Other data necessary for performance of the contract.

  1. Purpose of the processing and legal basis of processing

The company processes personal data only for the purpose of performance of the contract with the customer as a legal entity and data subject. The following information applies only to this purpose of processing.

The Company also processes personal data of its employees according to the applicable legal regulations. Information on this processing is solved by internal comnunication with employees and this document does not cover the processing of personal data of employees of the company.

There is no other processing of personal data in the company.

  1. Categories of recipients of personal data

Except for actions against public authorities, the company does not pass on personal data to anyone. Personal data are not transferred to third countries or to any international organization.

  1. Time of retention of personal data

The Company keeps personal data for the duration of the contractual relationship with the customer and subsequently 10 years after termination of the contractual relationship, in order to protect its legitimate interests in connection with the limitation period pursuant to § 629 et seq. Act No. 89/2012 Coll., the Civil Code, in the current version.

  1. Sources of personal data

The company collects personal data only from the data subjects, the company does not obtain personal data from any other subjects.

  1. Rights of the data subject

The data subject has the right in relation to his / her personal data:

Request from a company access to personal data,

Request a correction or deletion, or a limitation on the processing of personal data, if there is no contractual or legal reason for the processing,

Object to the processing of personal data,

The portability of personal data, and

File a complaint with the Office for Personal Data Protection, registered address at Pplk. Sochora 27, Prague 7, Postal Code: 170 00, Company ID: 708 37 627.

The data subject can request the information in written form. The written application must be accompanied by an officially verified signature of the applicant. In this way, the company will comply with the requirements of the Regulation which, by means of Articles 11 (2) and 12 (2), presuppose the proper identification of the applicant.

Information shall be communicated to the applicant in writing at the latest within one month from the request. If the applicant is interested, the information will be provided in an electronic form.

The provision of information may be charged if the requests are manifestly unfounded or disproportionate. The administrator shall provide the applicant with a free copy of the processed personal data. The Company may charge a reasonable fee based on administrative costs  for additional copies.

  1. Consequences of not providing of personal data

Due to the fact that the company processes personal data only for the purpose of performance of the contracts with the customer, it is not possible to conclude a contract with the customer in the event of not providing of personal data necessary to identify the customer (in the case of a legal entity identifying persons representing a legal entity) and performance of the contract.

  1. Automated processing of personal data

Personal data are not used for automated decision making, including profiling.
